Terms of use

These terms govern your use of the gojiCare website, intake, patient portal, and any associated services. Please read them carefully. by using gojiCare you agree to be bound by them.

1. Acceptance of terms

How you accept these terms and what happens if you do not agree.

Binding agreement

If you do not agree, please do not use the service. Continued use after we update these terms constitutes acceptance of the revised terms.

Who can use gojiCare

[v1 placeholder. pending legal review by gojiCare counsel] gojiCare is intended for adult residents of Canada who are 18 years of age or older. Eligibility for specific treatments is determined by your provincial regulator and by the licensed Canadian provider reviewing your intake.

2. Your account

Account creation, security, and your responsibility for activity on your account.

Creating an account

[v1 placeholder. pending legal review by gojiCare counsel] To use the patient portal you must create an account using a valid email address. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.

Account security

[v1 placeholder. pending legal review by gojiCare counsel] You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@gojicare.ca if you suspect unauthorized access.

Acceptable use

[v1 placeholder. pending legal review by gojiCare counsel] You agree not to misrepresent your identity, share account credentials, attempt to access another user's information, scrape or copy site content for redistribution, or use the service to obtain medication on behalf of someone else.

3. Fees and billing

What we charge for, when we charge it, and how disclosed pricing works.

Consultation fees

[v1 placeholder. pending legal review by gojiCare counsel] Some clinical services may carry a one-time consultation fee. The applicable fee, if any, is disclosed at intake before you authorize payment.

Medication and subscription fees

[v1 placeholder. pending legal review by gojiCare counsel] Medication pricing depends on the specific product, dose, and pharmacy fulfillment cost. For ongoing-care plans, fees recur on the cycle disclosed at signup until you cancel.

Taxes and shipping

4. Cancellations and refunds

How to cancel an ongoing plan and the limited cases in which refunds are issued.

Cancelling a plan

[v1 placeholder. pending legal review by gojiCare counsel] You may cancel any active subscription from the patient portal at any time. Cancellation stops future shipments and charges; it does not refund shipments that have already been dispensed.

Medication refund policy

[v1 placeholder. pending legal review by gojiCare counsel] Federal and provincial pharmacy regulations prohibit the resale or restocking of dispensed prescription medication. Refunds for shipped Rx medication are therefore limited to defective-product or fulfillment-error scenarios.

Consultation refunds

[v1 placeholder. pending legal review by gojiCare counsel] Consultation fees are refundable if a clinically necessary review has not yet been performed. Once a licensed provider has reviewed your intake, the fee is non-refundable regardless of the prescribing decision.

5. Intellectual property

Who owns gojiCare's content and what you can do with information you submit.

Our content

[v1 placeholder. pending legal review by gojiCare counsel] The gojiCare name, logo, brand assets, site copy, illustrations, and software are owned by gojiCare or its licensors and are protected by Canadian and international copyright and trademark law. You may not copy, redistribute, or create derivative works without prior written permission.

Information you submit

[v1 placeholder. pending legal review by gojiCare counsel] You retain ownership of the personal and health information you submit through intake, messaging, or the patient portal. You grant us the limited right to use that information for the sole purpose of delivering the service to you, as further described in the Privacy policy.

6. Medical disclaimers

What gojiCare is and what it is not. including when to seek in-person or emergency care.

Not for emergencies

If you are experiencing a medical emergency or are at risk of harm to yourself or others, call 911 or go to your nearest emergency department. For mental-health crises, contact 988 (Suicide Crisis Helpline).

Complement to in-person care

[v1 placeholder. pending legal review by gojiCare counsel] Online care has clinical limits. gojiCare complements but does not replace your relationship with a primary-care provider. Our clinicians will refer you to in-person care when that is the appropriate course.

7. Limitation of liability

The limits of our liability and the exclusions required by law.

Service provided as is

[v1 placeholder. pending legal review by gojiCare counsel] To the fullest extent permitted by law, the gojiCare website is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Liability cap

[v1 placeholder. pending legal review by gojiCare counsel] To the fullest extent permitted by law, gojiCare's total liability arising out of or relating to these terms or your use of the service is limited to the amount you have paid to gojiCare in the twelve (12) months preceding the event giving rise to the claim. Nothing in these terms excludes liability that cannot be excluded under applicable Canadian law.

8. Governing law and dispute resolution

Which Canadian laws apply and how disputes are resolved.

Governing law

[v1 placeholder. pending legal review by gojiCare counsel] These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws rules. Where a Quebec resident is using the service, the laws of Quebec apply to the extent required by the Quebec Civil Code.

Resolving a dispute

[v1 placeholder. pending legal review by gojiCare counsel] Before commencing any formal proceeding, you agree to first contact us at hello@gojicare.ca so we can attempt to resolve the matter informally. Any unresolved dispute will be brought before the courts of competent jurisdiction in the applicable province.

9. Quebec consumer rights

Additional disclosures required for residents of Quebec under the Consumer Protection Act.

Right to a French version

[v1 placeholder. pending legal review by gojiCare counsel] Residents of Quebec may request a French-language version of these terms by emailing hello@gojicare.ca. The French version will be considered the binding version for Quebec residents to the extent required by Quebec law.

Consumer Protection Act

[v1 placeholder. pending legal review by gojiCare counsel] Nothing in these terms limits any non-waivable right granted to you by the Quebec Consumer Protection Act (CQLR c P-40.1). Where any provision conflicts with a non-waivable right, that right prevails over these terms for the resident concerned.
